These are the general terms & conditions that apply to contract relationships that Divingworld offers in this web site. The offered products are related to diving and/or divers.

Following and completing the step-by-step purchasing process on the Divingworld web site means that you agree with the general buying conditions that appear herein.

PURPOSE

• The purpose of the following general buying conditions is to exchange the products offered on the Divingworld web site, in exchange of money.

CONTRACT FORMATION

• The user agrees with the general buying conditions presented in this text, once he/she accepts and fills out the application form.

ORDER RECEIPT, PRICE AND PAYMENT

• The price for each product is shown in the shopping cart of the web site. The price and the conditions may change, but the user will receive the price and conditions as dated at the moment of placing the order. This applies with the exception of a pricing error on the web site, in which case Divingworld reserves the right to charge the corrected price.

• Divingworld reserves the right to charge for an order from the moment it has been received.

• We must be notified of any order cancellations or changes before noon (12.00 o'clock midday) (Belgium time) on the day the order is placed. After this time the ordering process is considered to be completed. During the period of cancellation, the customer can cancel the order with no additional costs incurred. If the order is cancelled after this period of time and it has been shipped already, Divingworld will charge the customer for the transport expenses incurred for the cancellation.

• All purchases made from Divingworld must be paid electronically or by bank transfer. Divingworld reserves the right to request a bank transfer when they decide to do so.

• Divingworld invoices are charged in Euros at the exchange rate of the day of the shipment. Customers might be affected by a difference of the exchange rates between the moments of being charged by Divingworld and until this charge is effectuated by the user bank. This typically insignificant difference can work for or against the benefit of the customer and can not be controlled by Divingworld. As such Divingworld does not accept any responsibility.

• Divingworld offers all required information about the products and about its orders. The buyer has to fill out the order application forms following all Divingworld guidelines. Divingworld will protect all details and personal information in accordance with the law. The buyer has to pay the price of the product with the corresponding taxes and shipping costs.

PRODUCT WARRANTY

• All products offered by Divingworld are warranted. If a product sold by Divingworld has a manufacturing fault or is broken or damaged during shipping, Divingworld will repair it with no extra charge, exchange it for a new one, or give a refund. In these situations, the shipping costs incurred for the exchange or return will be paid by Divingworld. The buyer must inform Divingworld by e-mail within 8 days of receiving the order of any intentions relating to returning a product to ensure the best delivery procedure can be arranged. Otherwise additional costs incurred will be the responsibility of the customer.

SHIPPING COSTS

• The shipping costs for each order is shown in the shopping cart on the web site and can be seen clearly before the purchase is made.

• Divingworld will verify that the payment has been made correctly and then will send the product the following way Taxipost or colissimo.

• The buyer or a designated person must be at the address provided to us to receive and sign for delivery of the package when the package is delivered. If there is nobody there to receive the package, the shipping agency will attempt to deliver the package several times. After this, the package will be sent back to Divingworld. Divingworld will refund the money for the product, but will discount the shipping cost.

RETURNS

• During the eight days after the package has been received, the buyer can return the product to Divingworld. The product must be in perfect condition and must not have been used. The buyer must notfy Divingworld e-mail of intentions of returning the product(s), to ensure the best delivery procedure can be arranged and to avoid having to assume the incurred additional costs.

Valid reasons for returns are:

- The product is the wrong size

- We sent you the wrong product (in which case we apologise in beforehand)

- The product is faulty

• Divingworld will pay the shipping costs incurred for the exchange or return. In any other case, Divingworld does not assume these costs and they will be charged to the customer

GOVERNING LAW AND JURISDICTION

• The contract will be interpreted, construed and enforced in all respects in accordance with the laws of Belgium and you and Divingworld irrevocably submit to the jurisdiction of the Courts of Belgium.

• In addition to this, Divingworld adheres to the Consumer Arbitration System and thus abides by The Arbitral law. This system consists of a voluntary extrajudidicial procedure that is used when solving any dispute.The judgement by arbitration must be upheld and abided to the same as a judgment by a judge in a court of law.
